PROCEDURE FOR MORTGAGE FORECLOSURE SALES
All persons bidding at the sale MUST register their full name and mailing address. Please arrive at least 15 minutes prior to the start of the sales. After registering you will receive a numbered bidder paddle.
The following sale procedure will be followed at a sale unless otherwise ordered by the court.
- On the day of the sale, foreclosure files may only be viewed between 8:00 AM and 10:00 AM
- To bid, hold your card up and announce your entire bid clearly. Bids attempted in any other manner will not be recognized.
- After the final bid is accepted, the successful bidder or any Plaintiff overbids MUST deposit with the Clerk an amount of money equal to 5% of the successful bid along with the court's registry fee. The deposit shall be applied to the sale price at the time of payment. Failure to make this deposit will result in the sale being re-advertised for a future date.
- The balance of the successful bid MUST be paid to the Clerk by 4:00 p.m. the day of the sale. Failure to pay the balance by that time will result in the sale being re-advertised for a future date, and the costs of same will be paid from the deposit made at the conclusion of the sale, with any remaining funds applied towards the judgment.
- All payments to the Clerk MUST be by cash, credit card (3.5% fee) or cashier's check drawn on a bank physically located in the United States of America. All cashier's check MUST be made payable to the “Clerk of the Circuit Court.”
- Each individual sale will be announced by reading the style and number of each case; the date, time and place of the sale; and the publication date information. Legal descriptions will not be read.
- After the sales are completed, all successful bidders should wait in the main lobby until a deputy clerk calls your name.
